Fodder Scam: Hearing adjourned till October 17 on CBI’s plea against Lalu Yadav’s bail

The court has scheduled the hearing for October 17. While presenting Lalu's case during the CBI petition hearing, Kapil Sibal mentioned that Lalu had served a 42-month sentence in prison.

Fodder Scam: The Supreme Court has set October for the hearing on the appeal by the Central Bureau of Investigation (CBI) challenging the bail granted to Rashtriya Janata Dal (RJD) leader Lalu Prasad Yadav in the fodder scam case. Currently, the hearing on the plea against Lalu Prasad Yadav’s bail in the fodder scam case has been postponed in the Supreme Court. The court has stated that it will conduct the hearing on October 17. During the hearing of the CBI’s appeal, Kapil Sibal, representing Lalu Prasad Yadav, stated that Lalu had spent 42 months in jail and has undergone a kidney transplant. Lalu Prasad Yadav opposed the CBI’s plea to cancel the bail and has requested the dismissal of the CBI’s petition.

In response, Lalu Yadav has stated that challenging the high court’s decision to defer the sentence can’t be solely based on the premise that the CBI is dissatisfied with the verdict. There is no need to interfere with the high court’s decision, as it is founded on general principles and established norms. The former Chief Minister of Bihar, citing his deteriorating health and advancing age, mentioned that keeping him in custody would not serve the CBI’s purpose.

Essentially, the Central Bureau of Investigation (CBI) has approached the Supreme Court to cancel the bail granted to Lalu Prasad Yadav. The CBI has requested an expedited hearing from the Supreme Court. The CBI has challenged the bail orders in the Dumka, Dhoranda, Chaibasa, and Deoghar cases.

Before this, the Supreme Court had combined the CBI’s petition with the main petitions. In the Dhoranda treasury case, the CBI demanded the cancellation of bail granted to Lalu Yadav. The CBI has challenged the Jharkhand High Court’s bail orders. Earlier, Lalu Yadav had been granted bail in the Dhoranda treasury case. He had been released on bail in connection with the fodder scam, involving the embezzlement of funds related to the Chaibasa treasury, with a five-year sentence and a fine of ₹60 lakhs. He was considered the main conspirator in the fodder scam. Now, all the cases will be heard together before the same bench.

In the context of the fodder scam case, the CBI has challenged the plea made by Lalu Yadav, the leader of the Rashtriya Janata Dal, in the Supreme Court. On April 4, 2022, the Supreme Court had prepared for the hearing regarding Lalu Yadav’s bail in two cases.

The CBI has moved the Supreme Court against the two decisions of the Jharkhand High Court regarding Lalu Yadav’s bail in the Deoghar treasury case. In fact, the Jharkhand High Court had granted bail in the Deoghar treasury case based on the completion of half of the sentence and suspended the remaining sentence. The CBI has challenged the same decision in the Supreme Court. The High Court’s decision was issued on April 17, 2021, and October 9, 2020, granting Lalu Yadav bail in separate cases. This provided a pathway for his release from prison.
