New Delhi: The Supreme Court on Thursday said that the Madras high court’s observations against the Election Commission’s role to ensure Covid-19 protocols during the polls in four states and a Union Territory, were harsh and inappropriate.
“There is need for judges of superior courts to exercise restraint and not make off the cuff remarks in court proceedings,” the SC said.
The Madras high court had observed that EC officials concerned should probably be tried on murder charges for their failure to ensure adherence to Covid-19 protocols during the election process in four states and a Union Territory.
“High court observations do not form part of judicial records and hence there is no necessity to dwell further on the caustic observations made by Madras HC,” the SC said.
The SC bench also said that media discharges an important function in adding vitality to democracy and it cannot be restricted from covering court proceedings in any manner.
