SC dismisses plea challenging delimitation in Jammu & Kashmir

New Delhi: The Supreme Court on Monday dismissed a petition challenging the delimitation done for redrawing assembly and Lok Sabha constituencies in the Union Territory of Jammu and Kashmir. Justice SK Kaul and Justice AS Oka passed the order on a petition challenging the delimitation exercise carried out in the Union Territory of Jammu and Kashmir.

New Delhi: The Supreme Court on Monday dismissed a petition challenging the delimitation done for redrawing assembly and Lok Sabha constituencies in the Union Territory of Jammu and Kashmir. Justice SK Kaul and Justice AS Oka passed the order on a petition challenging the delimitation exercise carried out in the Union Territory of Jammu and Kashmir.

The Supreme Court has dismissed the petition of Haji Abdul Ghani Khan and Mohammad Ayub Mattu, who questioned the delimitation process. On May 13, 2022, the Supreme Court issued a notice on this matter. Then the court had made it clear that the hearing would be only on delimitation.

The issue related to the removal of Article 370 in Jammu and Kashmir will not be considered. In front of the bench of Justices Sanjay Kishan Kaul and Abhay S. Oka, the petitioner side argued that the constitution of the commission for the delimitation of assembly seats in Jammu and Kashmir is not correct according to the constitutional provisions.

The petitions said, ‘The correct procedure has not been followed in the delimitation. The boundary of the assembly constituencies has been changed in the delimitation. New areas have been included in it. The number of seats has been increased from 107 to 114, including 24 seats in Pakistan-occupied Kashmir. This is not in accordance with section 63 of the Jammu and Kashmir Reorganization Act. The Central Government, the Jammu and Kashmir Administration and the Election Commission had called this argument wrong.

Explain that after the removal of Article 370 in Jammu and Kashmir, the report was prepared by the Delimitation Commission, which was handed over to the government. Seven assembly seats were increased in the report. There were 43 seats in Jammu and 47 seats in Kashmir.
