SC refuses to hear plea seeking menstrual leave for girl students and working women

The Supreme Court has refused to hear the petition for menstruation leave of women. The court said that this issue comes under the purview of the government.

SC refuses to hear plea seeking menstrual leave for girl students and working women

The Supreme Court has refused to hear a PIL seeking leave for girl students and working women at their workplace during menstruation. In this petition, the court was requested to direct the states to declare a holiday for girl students and women in view of the pain caused by menstruation.

The PIL sought a direction to all states to frame rules for leave during menstruation for girl students and working women. This PIL was filed on behalf of Delhi resident Shailendra Mani Tripathi. The petition sought directions to the Center and all states to comply with Section 14 of the Maternity Benefit Act, 1961.

The Supreme Court said that this issue comes under the policy purview of the government. Chief Justice D.Y. A bench headed by Chandrachud said that a representation may be sent to the Union Ministry of Women and Child Development for taking a decision.

Holidays are available during periods in these countries

The petition filed said that periods leave is being given in countries like United Kingdom, China, Wales, Japan, Taiwan, Indonesia, South Korea, Spain and Zambia. It was said that during periods, women and girl students have to go through many physical and mental difficulties.
