Prayagraj: Samajwadi Party MLA Rafiq Ansari was arrested from Lucknow on Monday in connection with a non-bailable warrant from the Allahabad High Court. The SSP had formed a team under the leadership of CO Civil Line for his arrest.
The warrant issued against MLA Rafiq Ansari in the pending criminal case under sections 147, 436 and 427 of the Indian Penal Code was challenged in the court of Chief Judicial Magistrate, MP-MLA Meerut. An FIR was registered in September 1995 against 35-40 unidentified people in the case.
According to the facts of the case, an FIR was registered in September 1995 against 35-40 unidentified persons. After completion of the investigation, the first charge sheet was presented against 22 accused. Thereafter a supplementary charge sheet was presented against the petitioner, of which the concerned court took cognizance in August 1997. Rafiq did not appear in court, so a non-bailable warrant was issued on December 12, 1997.
Despite repeated non-bailable warrants (numbered 101) and attachment process under Section 82 CrPC, he did not appear in court and appealed in the High Court against the local court order. Here his lawyer argued that the 22 accused originally charged in the case were acquitted in the judgment dated May 15, 1997. Therefore, the case action against him should be cancelled.
The Court directed the Director General of Police to ensure execution of the non-bailable warrant already issued by the trial court against Rafiq Ansari. If the same has not yet been served and compliance affidavit will be filed on the next date. The court had directed to list the matter for July 22 for the limited purpose of filing the compliance affidavit.
SP City Ayush Vikram Singh said that even after that MLA Rafiq Ansari could not recall his non-bailable warrant. Therefore the police has arrested him from Barabanki.
