Veteran BJP leader BS Yediyurappa gets relief from Karnataka High Court in 2015 land case

Bengaluru: The Karnataka High Court has quashed a criminal proceeding against former Chief Minister BS Yediyurappa relating to illegal de-notification and allotment of sites. The case against the veteran BJP leader was registered by the Lokayukta police in 2015 based on the report of the Comptroller and Auditor General of India (CAG).

Bengaluru: The Karnataka High Court has quashed a criminal proceeding against former Chief Minister BS Yediyurappa relating to illegal de-notification and allotment of sites. The case against the veteran BJP leader was registered by the Lokayukta police in 2015 based on the report of the Comptroller and Auditor General of India (CAG).

This pertains to the de-notification of land by the government and the allotment of sites by the Bangalore Development Authority (BDA). Yediyurappa’s counsel submitted before a bench of Justice M Nagaprasanna that the same issue was covered in a judgment delivered by a coordinate bench of the High Court in 2016 in connected cases between similar parties.

The coordination bench had considered the allegations whether the report of the CAG could become the subject of registration of offense under sub-section (1) of section 154 of the Code of Criminal Procedure.

The 2016 judgment was quoted by Justice Nagaprasanna in his judgment on June 1 that “the CAG report not being available for judicial scrutiny cannot, in my opinion, be used to make out a criminal case and cannot be used for investigation”. The part cannot be made.”

The court said, “In the light of the issue covered in all its dimensions by the judgment delivered by the Co-ordinate Bench (supra), I consider it appropriate to quash the proceedings against the petitioner.”
