Yasin Malik Receives Medical Examination at AIIMS, Centre Assures Ongoing Treatment

Yasin Malik Receives Medical Examination at AIIMS, Centre Assures Ongoing Treatment

The Delhi High Court was apprised that Yasin Malik, a separatist leader serving a life sentence in a terror funding case, underwent a medical examination at the All India Institute of Medical Science (AIIMS) and received necessary medical treatment. The central government’s counsel and the director general of prisons (Tihar Jail) assured the court that Malik would continue to receive requisite medical attention as needed, addressing his reported cardiac and kidney problems.

Court Records and Disposal of Petition


Justice Anoop Kumar Mendiratta recorded the statements made by the counsel and disposed of Malik’s petition. In the petition, Malik sought a direction to authorities to produce records of his treatment and refer him to AIIMS or a private super-specialty hospital in New Delhi or Jammu and Kashmir for proper medical care.

Government’s Assurance and Compliance


Rajat Nair, representing the Centre and DG (Prisons), informed the court that Malik had been examined at AIIMS and discharged, receiving necessary medical attention. He emphasized that authorities are obligated to provide essential treatment to inmates. The court directed the copy of the order to be sent to the concerned jail superintendent for intimation and compliance.

Background and Legal Proceedings


Earlier on February 2, the high court had directed the Tihar Jail superintendent to ensure proper medical treatment for Malik. The petition, filed on Malik’s behalf through his mother Aatika Malik, claimed serious cardiac and kidney ailments. The Centre’s counsel contended that Malik, deemed a “very high-risk security prisoner,” could receive medical attention within the jail premises.

Yasin Malik, the chief of Jammu and Kashmir Liberation Front, received a life sentence on May 24, 2022, for offenses under the Unlawful Activities (Prevention) Act (UAPA) and the Indian Penal Code (IPC). The National Investigation Agency (NIA) has appealed to the Delhi High Court seeking the enhancement of Malik’s sentence from life term to death penalty, citing the severity of the charges. The court had awarded Malik a 10-year jail term for various offenses, including criminal conspiracy and raising funds for terrorist acts.
