New Delhi : In a landmark ruling, the Supreme Court has affirmed the right to privacy of electoral candidates concerning asset disclosure. The apex court declared that candidates are not obliged to divulge every asset they possess or that of their dependents, especially if such assets are irrelevant to their public role or voter perception.

The ruling by the Supreme Court assumes significance against the backdrop of ongoing Lok Sabha and assembly elections, where candidates are required to submit affidavits disclosing their assets. The court’s clarification ensures that candidates only need to disclose assets that significantly impact their public image or lifestyle and hold relevance for voters in making informed choices.

This verdict emerged during a case involving Independent MLA Karikho Kri from Arunachal Pradesh, whose election from Tezu in the 2019 Arunachal Pradesh Assembly polls was upheld by the apex court. The court underscored that voters do not possess an absolute right to information regarding every asset owned by a candidate.

The ruling by the Supreme Court, underscores the balance between electoral transparency and individual privacy rights, shaping the contours of electoral processes amidst evolving legal interpretations.
