Supreme Court refuses to stay ASI survey of Bhojshala complex in Dhar district of Madhya Pradesh

New Delhi: On Monday, the Archaeological Survey of India (ASI) to condict the survey at the contested sites of Bhojshala and Kamal Maula Masjid in Dhar, Madhya Pradesh allowed by Supreme Court, but said no action should be taken without its permission on the outcome of the ASI survey.

New Delhi: On Monday, the Archaeological Survey of India (ASI) to condict the survey at the contested sites of Bhojshala and Kamal Maula Masjid in Dhar, Madhya Pradesh allowed by Supreme Court, but said no action should be taken without its permission on the outcome of the ASI survey.

In addition to this, the top court has also issued notice on plea against Madhya Pradesh High Court order directing the ASI to conduct a survey in the disputed site “Bhojshala and Kamal Maula Masjid”. The apex court, in an interim order, has specified that no actions should be carried out based on the survey’s findings without its explicit permission.

The court said that no physical excavations should be conducted at the disputed sites, ensuring that their character remains unchanged during the survey process. On March 11, the High Court’s Indore bench had ordered the ASI to conduct a scientific survey of the medieval-era Bhojshala structure in the Dhar district. After receiving the survey. The HC has instructed the ASI to provide an updated report within six weeks.

The Supreme Court’s decision comes amid ongoing legal battles over the ownership and status of these historically important sites. Once the ASI survey is complete, it is expected to yield vital information about the historical and archaeological significance of the Bhojshala and Kamal Maula Masjid. However, until further directions from the Supreme Court, any action related to these sites will have to follow certain conditions laid down by the judiciary.
